RELEASE & RENTAL AGREEMENT
CUDDLE UP CABIN RENTALS, INC. LIABILITY RELEASE FORM

*Please read, sign, & return all 8 pages of release with your reservation authorization. (NOTE: No reservations can be confirmed prior to receipt of the executed Liability Release Form)!

For $10.00 and other valuable considerations, including but not limited to being allowed to stay at the cabin, I agree and acknowledge the following:

I hereby agree to hold Cuddle Up Cabin Rentals, Inc., its owners, employees and agents (individually and/or collectively as "Cuddle Up Cabin Rentals") and the Cabin Owners, their employees and agents (individually and/or collectively as "Cabin Owners") harmless and indemnify them against any and all claims, damages, suits, causes or action of damages and costs and legal expenses of any nature thereof arising from injury to a person or property or loss of life sustained in or about the cabin and associated surrounding lands and streets (the "Premises") by any person or persons whatsoever. I agree that Cuddle Up Cabin Rentals and the Cabin Owners shall not be liable for any personal injuries or damage to any goods, wares, or property regardless of how such injuries or damages may be caused.

Cuddle Up Cabin Rentals and the Cabin Owners will not be held responsible for lost or stolen items or items located or left on the Premises during my stay or after my departure.

Cuddle Up Cabin Rentals and the Cabin Owners will make no refunds for acts of nature or God, power outages, failure of utility services (including lack of water), failure of appliances, television services, and hot tubs (including but not limited to electrical breakers tripping appliances).

Acts of God/Construction Noise: Cuddle Up Cabin Rentals and the Cabin Owners shall not be liable for events beyond their control which may interfere with guest occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. NO DISCOUNT OR REFUND will be offered in these circumstances.

I understand there is an excessive amount of ladybugs during certain times of the year. I am also aware that there are wasps, bees and other insects that fly into the cabin. Flying squirrels are common in the woods and may enter the cabin. There will be NO REFUNDS due to these issues.

I am aware that, black bears, snakes, and other wildlife are in the mountains and I should take caution when hiking in the outdoors. I should not leave food in the garbage containers outside without making sure that it is securely wrapped in garbage bags, minimizing the attraction for bears or other wildlife.

In addition, I understand the cabin is not child proof and extreme caution must be used, including but not limited to the parent or legal guardian monitoring the child(ren) when children are occupying the premises, playing outside, or in or around the hot tub.

Please make sure to use caution around the property. Use of river, creeks, ponds, lakes, tire swings or any other outdoor activity is at the guests own risk.

Hot Tub Rules & Warning:

Hot tubs are not to be used as swimming pools, but only to be used for relaxation purposes for limited periods of time (no more than 10-15 minutes, generally, but consult your physician for exact limits). Women who are pregnant or think they may be pregnant, children under 12 years of age or anyone with a known heart condition or any health issue should NOT use a hot tub without their physician’s review and consent.

I am aware that hot tub use can result in, among other effects, damage to an unborn baby, collapsing of heart valves in young children, strokes and heart attacks, as well as skin rashes, fever, ear infections and death.

Cuddle Up Cabin Rentals drains the hot tub, scrubs the interior, cleans out the filter, purges the lines, refills the tub with clean water and stocks the hot tub with fresh chemicals before each check in. Once a guest enters the hot tub, the hot tub’s sanitation and chemical levels are compromised and CUDDLE UP CABIN RENTALS AND THE CABIN OWNERS CANNOT BE HELD RESPONSIBLE FOR ANY INFECTIONS (LIKE STAPH) THAT MAY OCCUR.

Please before any guests enter the hot tub, make certain they do not have any existing infections or skin irritations.

CUDDLE UP CABIN RENTALS AND THE CABIN OWNERS WILL NOT BE HELD RESPONSIBLE FOR INJURIES, ACCIDENTS, MEDICAL PROBLEMS, MEDICAL BILLS, OR DEATH RESULTING FROM USE OR MISUSE OF THE HOT TUB, AND I AGREE TO HOLD HARMLESS AND INDEMNIFY CUDDLE UP CABIN RENTALS AND THE CABIN OWNERS FROM THE SAME.

Policies:

Campfires are NOT to be built on the Premises.

Fireworks and/or firearms are NOT allowed on the Premises.

I am aware illegal drugs and/or underage and/or excessive alcoholic beverage use are absolutely prohibited and will result in my eviction with no refund.

I am aware that I cannot rearrange furniture or electronic equipment from their designated areas, or attempt to drain hot tub.

I am aware that Cuddle Up Cabin Rentals cannot guarantee against the mechanical failure of heating, air conditioning, Hot Tubs, TVs, Satellite Receivers, VCRs, well pumps or other appliances. I will report any problems with equipment to the company office immediately so that efforts to resolve the situation can be made in a timely manner. If repairs cannot be completed quickly or in an efficient time frame, I understand that Cuddle Up Cabin Rentals reserves the right to move me to another cabin for those reasons as well as any other reason as determined in Cuddle Up Cabin Rentals’ sole judgment and discretion. I also understand that no refunds or discounts will be given due to the failure of appliances or equipment.

I am aware that representatives of Cuddle Up Cabin Rentals have the right to enter the rental property at any time to respond to a service call for repairs or alterations, investigate disturbances, check occupancy, and check for damage.

I understand I am paying a cleaning fee. This DOES NOT mean Cuddle Up Cabin Rentals will allow me to leave the cabin or hot tub in an unsanitary condition. Any additional cleaning will be billed to me.

I am aware Cuddle Up Cabin Rentals has a strict NO SMOKING & NO PET POLICY (in cabins that are not pet friendly) and any violation of this policy will result in an automatic forfeit of my deposit. Any further damages or cleaning expenses will be billed to me.

Party will not bring a pet to a non-pet friendly cabin. AGREED _______, _______

In addition, I acknowledge I am at least 25 years of age, & have shown proof of identification at check in. Guests under the age of 25 unaccompanied by a parent or legal guardian will be permitted to register and will lose all funds paid to Agent. Any reservations made under false pretense will result in loss of advance payments and removal of guests from rental unit. NO House Parties!

Smoking is NOT permitted inside the cabin. We will charge additional fees to cover a thorough cleaning of upholstery, bedding, carpets and any other areas if smoke smell or discoloration from cigarettes & cigars is detected. Any violation of the "No Smoking" rule will automatically result in the loss of the renter’s entire security deposit.

Check Out Policies:

I am aware that if I depart early, shorten my rental days without the required notice being given, arrive late, or reschedule/cancel due to inclement weather, NO REFUND will be given. I am aware that Cuddle Up Cabin Rentals check out instructions must be followed as a courtesy to the housekeeping staff and renters that follow me. I understand that failure to follow the check out instructions provided could result in a monetary fine.

I am aware that I must leave ALL Rental Keys & gate passes where instructed, either on the kitchen counter or in the office lock box, upon my departure or I will be charged $20.00 for any un-returned keys & $75 for any un-returned gate passes. I am aware that if my party does not vacate the cabin(s) rented by 11:00 a.m. on the date of check out, without prior written consent from the Cuddle Up Cabin Rentals staff, or if any member of my party returns to the property after check out without company consent, I am subject to the charge of rental for (1) day.

Reservation Confirmation:

My party has paid for ______ number of persons to stay in the _________________________ Cabin, arriving on_____________________, and departing on_______________________________ . I agree to pay the total balance for this reservation ____________ (amount) in full as indicated on the booking summary on file with Cuddle Up Cabin Rentals reflecting accurate occupancy, discounts, and additional booking options. I understand if extra people stay overnight in the cabin and have not been paid for, Cuddle Up Cabin Rentals has the right to charge my credit card for those extra persons and if I am not willing to pay for the extra persons I may be evicted immediately & No Refund will be given for rental fees.

I understand that a credit card at time of check in, and as a security deposit against any possible damage done to the cabin. No charges will be made to the credit card as long as no damage is found evident and all policies have been met. If damages surpass the $250.00, additional charges will be applied. The amount of damages will include the replacement cost of any items damaged. If my credit card will not cover the additional charges, I will make arrangements with Cuddle Up Cabin Rentals or the cabin owners for replacing damaged items. By signing below, I agree that my credit card can and will be charged and I will not default on charges. This Agreement shall be construed, interpreted and the rights of the parties determined in accordance with and governed by the laws of the State of Georgia, without regard to conflicts of laws principles. It is expressly agreed and stipulated that this Agreement is deemed to have been made and to be performable in Fannin County, Georgia. Any action or proceeding seeking to enforce any provision of, or based on any right arising out of, this Agreement, and/or related to a contract or tort claim shall be brought against any of the parties in the courts of the State of Georgia, County of Fannin, and each of the parties consents to the jurisdiction of such courts (and of the appropriate appellate courts) in any such action or proceeding and waives any objection to venue laid therein. Process in any action or proceeding referred to in the preceding sentence may be served on any party anywhere in the world.

I have read, understand, and consent to all the policies and regulations on the previous pages as well as those listed on the accompanying Rental Statement.

Renter must register all occupants below on this form including children. Parents must sign all names of the children and by signing indicate their legal responsibility for same and consent for same to the stipulations in this agreement. Renter cannot have visitors that are not registered with the office. If you are planning for visitors to visit the cabin, the office must be made aware in advance within the office’s normal office hours. Visitors will have to register with the office and sign the Liability Release Form before arrival. A visitor is considered anyone visiting only and NOT (staying overnight will qualify the visitor as a renter and result in an additional charge). Any guest found on the premises that is not registered will be asked to leave. Renter will be subject to forfeiture of deposit for any violation of these rules and we reserve the right to evict renter and all occupants.
